Terms of Service
Effective date: 1 June 2025
1. Agreement to terms
By accessing or using TinTorch CRM ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
The Service is provided by e10 infotech, a company incorporated in India ("e10 infotech," "we," "us," or "our"). If you do not agree to these Terms, do not use the Service.
2. Account terms
- You must provide accurate, current, and complete registration information.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately at hello@tintorch.com if you become aware of any unauthorized access.
- You must be at least 18 years old to use the Service.
- One person or legal entity may not maintain more than one free account.
3. Acceptable use
You agree not to use the Service to:
- Send unsolicited bulk email (spam) or violate anti-spam laws including CAN-SPAM, CASL, or GDPR.
- Transmit content that is unlawful, defamatory, harassing, abusive, fraudulent, or obscene.
- Impersonate any person or entity, or misrepresent your affiliation.
- Distribute malware, viruses, or other harmful code.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Resell, sublicense, or commercially exploit the Service without our written consent.
- Violate any applicable laws or regulations, including data protection and privacy laws.
- Use the Service to contact individuals who have not consented to receive your communications.
We reserve the right to suspend or terminate accounts that violate these acceptable use provisions, without prior notice.
4. Billing and payments
- Paid plans are billed in advance on a monthly or annual basis.
- All fees are quoted in US dollars and are non-inclusive of taxes.
- You authorize us to charge your payment method on file at the start of each billing period.
- If payment fails, we will notify you and may suspend access until payment is resolved.
- Price changes will be communicated at least 30 days in advance.
- Downgrading your plan may result in loss of features or data — we will warn you before this happens.
5. Refunds
Monthly subscriptions are non-refundable after the billing date. Annual subscriptions are eligible for a pro-rated refund within 30 days of purchase if you are not satisfied — contact hello@tintorch.com to request one. We do not offer refunds for partial months or for accounts terminated due to violations of these Terms.
6. Intellectual property
The Service and all content, features, and functionality — including but not limited to software, text, displays, images, and design — are owned by e10 infotech and are protected by Indian and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written consent.
You retain ownership of all data and content you upload to the Service. By uploading content, you grant us a limited, non-exclusive license to process and store it solely to provide the Service to you.
7. Privacy
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.
8. Uptime and service levels
We aim for 99.5% monthly uptime for paid plans. Scheduled maintenance windows are excluded from uptime calculations and communicated at least 24 hours in advance. We do not guarantee uninterrupted access to the Service and are not liable for downtime beyond our stated SLA.
9. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or that defects will be corrected.
10. Limitation of liability
To the fullest extent permitted by applicable law, e10 infotech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business interruption, arising out of or related to your use of the Service.
Our total cumulative liability to you for any claims arising out of these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 100.
11. Indemnification
You agree to indemnify and hold e10 infotech and its officers, directors, employees, and agents harmless from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Termination
You may cancel your account at any time from your account settings or by emailing hello@tintorch.com. We may terminate or suspend your access immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
Upon termination, your right to use the Service ceases immediately. You may export your data within 30 days of cancellation — after this period, we may delete your data.
13. Governing law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts located in India.
14. Changes to these terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or an in-app notice at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
